Terms of Service

1. Agreement

By using MyVote ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

The Service is operated by MyKura Technologies ("we", "us"), registered in Kenya.

2. What MyVote is

MyVote provides two distinct services:

• Civic tools — a public polling station locator, candidate directory, and election information, free to all users.
• Campaign platform — paid tools for candidates, campaigns, and parties, including websites, dashboards, donations, and analytics.

3. What MyVote is not

• We are not affiliated with IEBC or any government body.
• We are not a political party and do not endorse candidates.
• We are not a voting platform. No vote can be cast through MyVote.
• We are not a source of official results. Official results come from IEBC.

Where we display polling station data or historical turnout, it is provided as-is for civic convenience and may be outdated or incomplete. Always verify with iebc.or.ke.

4. Acceptable use

You agree not to:

• Use MyVote to spread misinformation, hate speech, or incitement.
• Impersonate a candidate, official, or another person.
• Scrape, harvest, or bulk-download data from the Service.
• Attempt to breach, DDOS, or reverse-engineer the platform.
• Use automated tools to manipulate QR scan counts, donation figures, or analytics.
• Upload content that infringes copyright, trademark, or privacy rights.
• Use the Service in violation of the Elections Act, Political Parties Act, Campaign Financing Act, Computer Misuse and Cybercrimes Act, or any Kenyan law.

We may suspend or terminate accounts that violate these terms.

5. Candidate & campaign accounts

If you register a campaign account:

• You are responsible for the accuracy of your content (manifesto, bio, events, donations).
• You must be legally eligible to run for the office you are campaigning for.
• You must comply with all campaign finance and disclosure laws.
• You must not use MyVote to collect donations for anything other than a legitimate campaign expense.
• You must not solicit or accept foreign donations where prohibited by Kenyan law.
• Donations flow directly to your M-Pesa Paybill or Till. MyVote is not a payment processor and does not take a cut of donations.

You grant MyVote a non-exclusive, worldwide, royalty-free license to host, display, and distribute your campaign content through the Service.

6. Fees & subscriptions

• Subscription fees are billed per the pricing on myvote.co.ke.
• Fees are non-refundable except where required by law.
• We may change pricing with 30 days' notice.
• Failure to pay may result in suspension of your campaign site.

7. Content you upload

You retain ownership of content you upload. You confirm that you have the rights to publish it and that it does not infringe anyone else's rights.

We may remove content that violates these Terms, Kenyan law, or public order, with or without notice.

8. Our content

All software, design, maps, and content on MyVote (other than content uploaded by users) are owned by MyKura Technologies or licensed to us. You may not copy, redistribute, or reuse them without written permission.

Polling station data may be derived from public IEBC sources and is used under fair-use and civic-purpose principles.

9. Disclaimers

The Service is provided "as is" and "as available". We do not warrant that polling station locations, candidate data, historical turnout, or any information will be accurate, complete, or up to date.

Always verify critical information with IEBC or official sources before election day.

10. Limitation of liability

To the maximum extent permitted by Kenyan law, MyKura Technologies and its officers, employees, and partners shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service — including (without limitation) missed voting, misinformation, donation disputes, or electoral outcomes.

11. Indemnity

You agree to indemnify MyKura Technologies against any claim, loss, or expense arising from your use of the Service, your content, or your breach of these Terms.

12. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, or if required by law. Sections 8, 10, and 11 survive termination.

13. Changes to these Terms

We may update these Terms. Continued use of the Service after a change means you accept the new Terms.

14. Governing law

These Terms are governed by the laws of Kenya. Disputes shall be resolved in the courts of Kenya.
